Terms & Conditions
1. Definitions
1.1 "Client" means the person or persons, firm or company
who has contracted to purchase Services from iQ Studio.
1.2 "Contract" means the contract made between iQ Studio
and the Client for provision of the services.
1.3 "Services" means the services provided to the Client
by iQ Studio, including the hire of the venue, under the
contract.
1.4 "Respondents" 'means any individual or organisation from
or about whom data is collected or is approached for interview'
(MRS Code of conduct.)
1.5 "Working day" means a full standard working day of 09:30
to 17.30 Monday to Friday (excluding Bank Holidays), i.e.
cancellation of a booking at 10.30am on Monday for the Friday
of the same week constitutes four working days notice.
2. Contract
2.1 These terms and conditions, together with the attached
booking form shall constitute the entire Contract between
iQ Studio and the Client and supersedes all prior written
or oral understanding relating to the subject matter of this
Contract.
2.2 These terms and conditions shall not be amended or supplemented
except as agreed in writing by authorised representatives
of the parties.
2.3 Booking forms and deposits must be received 5 days in
advance of attendance, Clients requiring catering are required
to confirm orders by 2pm the day before arrival.
3. Quotations
3.1 The fees quoted in any proposal submitted by iQ Studio
to the Client will, unless agreed by both parties in writing,
be valid for a period of two calendar months from the date
of issue. iQ Studio reserve the right to revise quotations
following this period or on the basis of changes in Client
requirement.
3.2 Quoted fees are exclusive of VAT; where required by law
any VAT will be charged in addition to the fees.
3.3 Provisional bookings will only be held subject to availability.
If another company requests the same booking, the original
Client will have the option to confirm before it is released.
4. Terms of Payment
4.1 iQ Studio shall be entitled to invoice the Client for
the fees on completion of the Services. The Client shall
make payment with 30 days of the invoice date.
4.2 iQ Studio reserves the right to charge for cancellation
according to the following rates.
(i) Up to 1 working days notice (100% Rental fee only)
(ii) Up to 5 working days notice (50% Rental fee only)
These charges also apply for postponement of guaranteed bookings
unless another booking for a similar value is received.
4.3 All quotations are in Euro unless otherwise stated and
all payments must be made in Euro unless agreed at the time
of confirmation.
5. Venue
5.1 The Client will have access to the venue on the dates
and time specified in the Contract and shall vacate the premises
by the end of the agreed time schedules, should the client
fail to vacate the venue by a specified end time or agree
an extended hire timeframe iQ studio shall be entitled to
charge for any reasonable extra costs incurred.
5.2 The Client shall observe any rules or regulations ascertaining
to the use of the venue, and shall not enter or trespass
on any premises adjacent to the venue, and shall ensure that
any individual(s) brought into the venue comply with such
rules and regulations etc.
5.3 iQ Studio reserve the right to refuse to admit, or to
order the removal of any individual in violation of the provisions
of sub-clause 5.2, or who in the reasonable opinion of iQ
Studio staff is not a fit person to be in the Studio.
6. Liabilities
6.1 iQ Studio accept no liability due to disruption or delay
due to major utility failure, inclement weather, transport
disputes, disruptions, bomb scares, fuel shortages , major
sporting events or any other reason beyond our control
6.2 iQ Studio will endeavour to provide Services as outlined
in the Contract. However should iQ Studio be prevented or
fail to provide these Services or in the event of no recordings
being available due to equipment malfunction, you will be
offered either a sum equal to the fees paid or an equivalent
replacement booking.
6.3 iQ Studio will accept no liability for loss or damage
to client's property or stored materials, vehicles or their
contents. Clients should ensure their own insurance covers
articles stored on our premises.
6.4 The Client shall be responsible for complying with any
legislation relating to the Clients products, samples or
materials, including the supply of any COSHH certificates.
6.5 In such cases as the Client is responsible for damage
caused to equipment or facilities the Client will be liable
for repair or replacement costs.
6.6 Confirming a booking with iQ Studio acts as confirmation
by the Client they understand their responsibilities under
the Irish Data Protection Act 1998 and the MRS Code of Conduct.
6.7 iQ Studio does not undertake recruitment. This is wholly
the responsibility of individual recruiters or recruitment
companies.
